VIE CONTEST RULES (Very Important Exerciser Contest)
ELIGIBILITY AND ENTRY RULES
No purchase is necessary. You must have email access to be eligible for the VIE Contest. The VIE Contest is open to legal residents of the State of Ohio, 18 years of age and older, and who reside in northeast Ohio. Northeast Ohio is defined as "the counties of Cuyahoga, Summit, Stark, Medina, Lorain, Lake, Ashtabula, Portage, Mahoning, Trumbull, and Geauga". Employees of Body Sculpting by Exterior Designs, Inc.® (hereinafter BODY SCULPTING), JOHN ROBERTS STUDIO (hereinafter JRS), BMW Cleveland (hereinafter BMW), Dr. Richard E. Betor (hereinafter REB), Advanced Medicine & Laser Institute (hereinafter KARA), Cafe Tandoor Restaurants (hereinafter CTR), Permanent Enhancements (hereinafter PE), Rinaldi Jewelers (hereinafter RJ), Health Choice Screenings (hereinafter HCS), and The EPA (hereinafter EPA) and their employees or independent contractors, members of their immediate families (including spouses, parents and children), persons living in the same household of such, and all advertising and promotional agencies involved in the VIE Contest, are not eligible. The contest is void where prohibited or restricted by law. Limit one entry per person. The contest is subject to all applicable federal, state, provincial and local laws and regulations.

You will be asked to provide information such as your first and last name, address, telephone number, your email address, and how you’ve heard of us. This information is kept confidential, is never shared with third parties, and is for Body Sculpting's, JRS's, BMW's, REB's, KARA, PE, EPA, RJ, HCS, and CT's use only.
Entries will be declared made by the authorized account holder of the email address submitted at the time of the entry. The "authorized account holder" is defined as the natural person who is assigned to an email address by the organization that is responsible for assigning email addresses for the domain associated with the submitted email address. All entries become the property of Body Sculpting and will not be acknowledged or returned.

Using any of the entry methods, a contestant may enter the contest only once. All entries must be received by December 31, 2008. The odds of winning will be determined by the number of eligible entries received.
DATES & DRAWING
The contest starts January 1, 2007 and goes through December 31, 2008. The winner will be chosen on January 10, 2009 and announced by February 28, 2009 pending notification and verification of winner.
WINNER SELECTION
There will be one Grand Prize Winner per drawing. The Grand Prize Winner will be selected in a random drawing from among all eligible entries received by December 30, 2008. The random drawing will be conducted under the supervision of Body Sculpting whose decision is final and binding. The winner will be notified via email and/or telephone, and/or written notification. Odds of winning depend on the number of eligible entries received.
PRIZES
The Grand Prize Winner will receive all of the following: a year's worth of exercise classes from Body Sculpting by Exterior Designs, Inc., ($600 maximum value), a Spa package from JRS (value $900), a store Gift Certificate (value $100) from BMW and a Car Detail (value $250) from BMW, a Laser Teeth Whitening treatment (value $550), a skin treatment from KARA (value $250), a $50 Gift Certificate from CT, a $250 Gift Certificate from RJ, a $50 Gift Certificate from PE, a $150 Gift Certificate from Health Choice Screenings, and a Free Month of Grocery and Errand Running Services by EPA. Prizes are not transferable, not redeemable for cash, and may not be bartered or sold. The Grand Prize will be awarded in the name of the Grand Prize Winner only. The Grand Prize Winner will have until January 31, 2009 to use their prizes. Expenses not specifically stated are the sole responsibility of the Grand Prize Winner such as the purchase of weights, a stretch band, an exercise mat or other items, gasoline expenses to and from the sponsors' place of business, or any other expense related to the participation that the winner may or may not need in order to participate in the services or treatments. Body Sculpting, Inc. and its VIE Contest Sponsors make no warranty, guaranty, or representation of any kind concerning any prize.
TERMS
VIE Contest entrants agree to abide by these Official Rules and by the decision of Body Sculpting whose decision is final. The VIE Contest is governed by the laws of the United States and the State of Ohio. All federal, state and local laws and regulations apply. Body Sculpting reserves the right to terminate or modify the VIE Contest at its sole discretion and at any time.
CONDUCT
By entering this VIE Contest, you agree to be bound by these Official Rules. The Official Rules will be posted at flexcity.com on the VIE Contest page. Entrants further agree to be bound by the decisions of the judges which shall be final and binding in all respects. Body Sculpting reserves the right at their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or website; to be acting in violation of the Official Rules; or to be acting in disruptive manner, or with intent to annoy, abuse, or harass any other person.
NOTIFICATION
Prize winners will be notified via email and/or telephone, and/or by written notification within ten (10) business days after the drawing date and may be asked to sign and return an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release (all notarized) within ten (10) business days following attempted notification, or the prize will be forfeited and awarded to an alternate winner. The name of the prize winner will be advertised on Body Sculpting's website at flexcity.com under TODAY'S NEWS as well as other publications, websites, or other publicity venues
ADDITIONAL TERMS
By participating in the VIE Contest, entrants further agree:
1.) To the Official Rules, and to the decisions of the judges which shall be final in all respects; and
2.) To allow Body Sculpting to use and publish their name and/or likeness and/or photographs online and in print, or any other media, for advertising and promotional purposes without additional compensation unless prohibited by law, and to execute specific consent to such use if asked to do so; and,
3.) To release, discharge and hold harmless Body Sculpting, JRS, BMW, REB, KARA, PE, EPA, and CT and/or its subsidiaries, affiliates, directors, officers, employees, independent contractors, instructors and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the VIE Contest or any prize won, or theft arising from the participation in said exercise classes, spa package, tooth whitening, skin treatments, and the travel related to and from said exercise classes, the spa package, the tooth whitening, or the skin treatment. Restrictions, conditions, and limitations apply.
4.) Entry information becomes the property of Body Sculpting. No substitutions, credit, or cash redemption can be made on any prize won. Contest rules are subject to periodic changes.
CONDITIONS AND LIMITS OF LIABILITY
No responsibility is assumed by Body Sculpting for telephone, network, electronic or computer failures of any kind, or for entries that are stolen, misdirected, incomplete, garbled, delayed by computer transmissions, lost, late, misdirected, illegible, or mutilated. Body Sculpting and its VIE sponsors are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the VIE Contest or by any technical or human error which may occur in the processing of submissions in the VIE Contest or by illegible handwriting that cannot be deciphered. Body Sculpting and its VIE sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. Body Sculpting is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this VIE Contest. If, for any reason, the VIE Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Body Sculpting which corrupt or affect the administration, security, fairness, integrity or proper conduct of this VIE Contest, Body Sculpting and its VIE Sponsors reserve the right, at their discretion, to cancel, terminate, modify or suspend the VIE Contest.
